The North Carolina State Bureau of Investigation (SBI) arrested Smithey on Wednesday afternoon.
Smithey, 48, was charged with possession of methamphetamine and felony conspiracy to possess methamphetamine, according to a statement from the SBI.
Smithey was placed in the Wilkes County Jail, a facility located directly behind the Wilkes County Courthouse where her office is located, and held on a $5,000 bond.
A post by the SBI on Wednesday says “Smithey has been charged with possession of methamphetamine and conspiracy to possess methamphetamine. She was taken into custody without incident and booked into the Wilkes County Detention Center this afternoon. Further details about the investigation, including potential additional suspects or charges, are not being released at this time due to the ongoing nature of the case.”
According to reports, court records filed in Wilkes District Court state that the charges stem from an alleged offense on Feb. 19, 2026.
Smithey is a former resident of Alexander County.
She is scheduled for a first appearance in Wilkes District Court today.
