The District Attorney’s Office argued for murder but the jury decided on voluntary manslaughter. Kuhns and Dockery had exchanged words earlier in the day and The Alexander County Sheriffs Office had been called. Dockery had left Kuhns home but returned and that’s when the fatal shooting took place. Kuhns had claimed self defense although Dockery was unarmed.
Judge Lynn Gullett sentenced Kuhns to a minimum of 73 months(6 years plus 1 month) and a maximum of 100 months (8 years plus one month) in prison. Kuhns will be given credit for time served in jail since the shooting which amounts to 589 days. The jury started deliberating Kuhn’s fate last Thursday afternoon. They were dismissed at the end of the day Thursday and returned Friday morning returning a verdict around 4pm.
